Updated P&C Constitution Introduced to Strengthen Governance and Safeguards

New legislative provision to safeguard Parents & Citizens’ Associations and updated P&C model constitution
Recent changes to the Education (General Provisions) Act 2006 now prohibit individuals convicted of indictable offences from serving on a Parents and Citizens’ (P&C) Association executive committee or subcommittee.
15.1.8 A person is disqualified from becoming or continuing as a member a P&C Association’s executive committee and subcommittees if they have an active conviction for an indictable offence.
This amendment aligns with school council legislation and aims to uphold the integrity of P&Cs.
To reflect these changes, the Department of Education’s model constitution and Schedule 3 P&C Membership Nomination Form, have been updated. This updated constitution can be adopted at the next P&C annual general meeting, or at a special meeting called for the purpose.

P&Cs Qld suggests that all P&Cs convene a special meeting, which can be held immediately prior to your next general meeting with the provision of 7 days’ notice to all members. This special meeting would have just one agenda item: To adopt the new P&Cs Constitution. Adopting the new constitution at the earliest convenience allows the P&C to take advantage of the new additions and conditions.
Other key clause changes are;
Allowance of electronic membership forms:
14.3.1 A person must apply for membership of the Association by personally completing and submitting an application for membership to the Association by post, email or other digital means in the form of the example at Schedule 3.
Provision for P&Cs to donate funds to other schools impacted by adverse events:
23.7.2 The Association may resolve to provide donations in the form of financial assistance, support services or other resources to assist another state P&C Association or state school impacted by an adverse event such as a natural disaster.
